Onsite and Excess Soil Regulations (O.Reg. 406/19): Simplified

The province of Ontario estimates that approximately 25 million cubic meters of excess soil are excavated each year. While much of this soil can be safely reused, some may contain contaminants that pose risks to groundwater, surface water, and the surrounding environment. To address these concerns, Ontario introduced new regulations starting in 2021, with additional measures being phased in through 2025, ensuring safer and more sustainable soil management practices.

What’s Changing?
MATRIX at the Forefront of Ontario’s New Soil Regulations

Ontario’s Onsite and Excess Soil Regulations (O.Reg. 406/19) are transforming how soil is managed, and MATRIX is leading the way in helping clients adapt to these changes. From new reuse rules to stricter landfill restrictions, MATRIXensures your projects remain compliant and efficient.

Reuse Rules (Effective January 1, 2021)
New regulations define how excess soil can be handled and safely reused. They clarify waste designations, providing clear guidelines for assessing and managing soil. MATRIX is here to help you navigate these rules, ensuring your soil management plans align with the latest requirements.

Testing, Tracking, and Registration (Effective January 1, 2022)
Regulations now require specific testing and tracking of soil before it leaves the site. The extent of these requirements depends on the type and scale of the project. Larger projects must also complete online registrations. MATRIX simplifies this process by creating customized soil sampling plans, managing testing protocols, and ensuring compliance with tracking and registration mandates.

Reducing Waste Soil at Reuse Sites
New measures aim to reduce the accumulation of waste soil at large reuse sites. Soil sampling plans and detailed soil characterization reports are becoming essential. MATRIX provides expert support in developing these reports and ensuring that soil meets all reuse criteria, streamlining the process and reducing unnecessary waste.

Landfilling Soil Restrictions (Effective January 1, 2025)
Restrictions will limit the disposal of clean soil at landfill sites unless it serves a beneficial purpose, such as cover material. MATRIX helps clients find alternative, compliant solutions for excess soil management, minimizing landfill dependency and promoting sustainable practices. As Ontario’s soil regulations evolve, MATRIX is at the forefront, offering the expertise and strategies you need to stay ahead of these changes while achieving your project goals.
